Virgin Mobile 'LA Surprise Gig' Promotion - Terms and Conditions
1. The promoter of this promotion is Virgin Mobile (Australia) Pty Limited ABN
67 092 726 442 of Level 8, 213 Miller Street, North Sydney New South Wales 2060. Phone: 02 9028 1600 ("Promoter").
2. Information on how to enter the promotion and prize forms part of these Terms and Conditions. Entry into the promotion is deemed acceptance of these Terms and Conditions.
3. Entry is open to all residents of Australia 18 years and over ("Eligible Entrant"). Directors, officers, and employees (or immediate family of a director, officer, employee) of the Promoter and its related bodies corporate and the agencies associated with this promotion are ineligible to enter.
4. The Promotion starts at 9.00am AEST 9 July 2010 and closes at 11.59pm AEST on 8 August 2010 ("Promotional Period").
5. To enter and be eligible to win a prize in this promotion, an Eligible Entrant must, during the Promotional Period, either:
(a) for entry via a PC: log onto www.memberslounge.com.au or www.virginmobile.com.au with their Virgin Mobile My Account details, follow the prompts to the competition entry page, locate and click on the prize draw icon, input the requested details and submit the fully completed entry form; or
(b) for entry via an internet capable mobile device: log onto www.memberslounge.mobi from their Virgin Mobile handset, follow the prompts to the competition entry page, locate and click on the prize draw icon, input the requested details and submit the fully completed entry form.
By entering this promotion, individuals agree to receive future communication from the Promoter.
6. Only one (1) entry per Eligible Entrant is permitted. All Eligible Entrants will be automatically entered into the prize draw.
7. The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an Eligible Entrant's identity, age and place of residence) and to disqualify any Eligible Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
8. The Promoter's decision is final and no correspondence will be entered into.
9. This is a game of chance. Prize draw will be carried out by computer and will occur at 3.00pm AEST on 9 August 2010 at Mobux Pty Ltd, 7/50 Reservoir Street, Surry Hills, NSW 2010.
10. Winners announced: The prize winners (of prizes valued at over $250) will be notified by telephone and mail within 2 days of the prize draw. The prize winners' names will also be published in The Australian on 16 August 2010.
11. There will be 44 prize winners.
12. The first valid entry drawn will be the winner of the 'Virgin LA Surprise Gig' experience valued at up to $8,500 RRP depending on date and point of departure. 'Virgin LA Surprise Gig experience' prize is a trip to Los Angeles, California for 2 adults and includes: return economy airfares from winner's nearest capital city to Los Angeles, 3 nights twin share accommodation of at least 3 stars and 2 tickets to a 'Surprise Gig' on 23 September 2010, which will be a music event featuring an internationally renowned band.
13. Transfers to and from departure point, additional transfers, insurance (such as travel or health cover), passports, visas (if required), vaccinations, spending money, items of a personal nature, taxes, meals, drinks and snacks from the hotel mini bar and any in-room charges and all other ancillary costs are not included. Full details of the prize will be supplied to the winner following notification. The Promoter will determine the dates in which the 'Virgin LA Surprise Gig' experience prize must be taken on, in its absolute discretion. The 'Virgin LA Surprise Gig' experience prize must be taken the dates stipulated by the Promoter but will be prior to 1 October 2010. Frequent flyer points will not form part of the 'Virgin LA Surprise Gig' experience prize. 'Virgin LA Surprise Gig' experience prize is subject to the standard terms and conditions of individual prize and service providers. Winner may be required to present credit card at time of accommodation check in.
14. The friend chosen by the winner to participate in the prize must be aged 18 or over at the time the winner claims the prize. The winner and the winner's companion are each responsible for ensuring they each have a valid passport, are eligible for a USA visa waiver programme or are in possession of a valid USA visa, as appropriate, and for ensuring they have travel insurance and any vaccinations required.
15. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant regulatory authority.
16. The next 15 entries drawn will each receive a Sony Ericsson Vivaz handset, valued at $696 RRP.
17. The next 28 valid entries drawn will each receive a 700ml bottle of Smirnoff Vodka, valued at $37.00 RRP.
18. The Promoter encourages consumers to enjoy responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are available at www.nhmrc.gov.au. Entry and continued participation in this promotion is subject to the licensee's liquor serving policy.
19. Total prize pool value is up to $19,976 RRP.
20. If any prize (or part of a prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute that prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
21. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
22. If any prize winner cannot be contacted despite every reasonable effort made by the Promoter by 2.00pm AEST on 16 August 2010, their prize will then be deemed unclaimed. The Promoter may conduct a draw, as may be deemed necessary, at 3.00pm AEST on 16 August 2010 at Mobux Pty Ltd, 7/50 Reservoir Street, Surry Hills, NSW 2010 in order to distribute any prizes if unclaimed. Prize winners, if any, will be notified by telephone and mail within two (2) days of the prize draw and published in The Australian on 23 August 2010.
23. Eligible Entrants consent to the Promoter using the Eligible Entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
24. All entries remain the property of the Promoter. A copy of the Promoter's privacy policy can be found at www.virginmobile.com.au. The Promoter collects Eligible Entrants' personal information in order to conduct the promotion. If the information requested is not provided, the Eligible Entrant may not participate in the promotion. By entering the promotion, unless otherwise advised, each Eligible Entrant also agrees that the Promoter may use this information to contact you for future promotional, marketing and publicity purposes including sending electronic messages or telephoning the Eligible Entrant. Eligible Entrants' personal information may be disclosed to State and Territory Lottery Departments and the winners' name published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter at their address set out above.
25. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Eligible Entrant; or (f) use of a prize.
26. To the maximum extent permitted by law, the Promoter shall not be liable for any loss and/or personal injury suffered by or to the winner and/or any of his/her friends that occurs as a result of the winner's and/or his/her friends' participation in the prize. The winner shall be responsible for any damage to the hotel or other venues (including their contents) visited by the winner and his/her friends throughout the trip caused as a result of a deliberate or negligent act or omission of the winner or one or more of his/her companions. As a condition of accepting the 'Virgin LA Surprise Gig' experience prize, the winner (and any companion/s) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
27. The Promoter and event organizers expressly reserve the right to eject any winner (and/or his/her companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize, or if the Promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize.
28. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of or in connection with this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter, including without limitation technical malfunctions or failures.
29. If for any reason this promotion is interfered with in any way or is not capable of running as planned in any respect due to any cause beyond the reasonable control of the Promoter, the Promoter reserves the right in its sole discretion to the fullest extent permitted by law (a) to disqualify any Eligible Entrant; or (b) cancel, postpone or amend the promotion subject to the written directions of any regulatory authority.
