TERMS AND CONDITIONS
1.Information on how to enter and prizes form part of these Terms and
Conditions. Participation in this promotion is deemed acceptance of these
Terms and Conditions.
2.Entry is only open to Australian residents 18 years and over who hold an
active Virgin Mobile account as at the draw date. Employees (and their
immediate families) of the Promoter and agencies associated with this
promotion are ineligible to enter.
3.To enter, individuals who hold an active Virgin Mobile account must, during
the promotional period, either:
for entry via a PC: log onto www.memberslounge.com.au or
www.virginmobile.com.au with their Virgin Mobile My Account
details, follow the prompts to the competition entry page, locate
and click on the prize draw icon, input the requested details and
submit the fully completed entry form; or
for entry via an internet capable mobile device: log onto
www.memberslounge.mobi from their Virgin Mobile handset,
follow the prompts to the competition entry page, locate and
click on the prize draw icon, input the requested details and
submit the fully completed entry form.
By entering this promotion, individuals agree to receive future communication
from the Promoter.
4.The Promoter reserves the right, at any time, to verify the validity of entries
and entrants (including an entrant’s identity, age and place of residence) and
to disqualify any entrant who submits an entry that is not in accordance with
these Terms and Conditions or who tampers with the entry process. Errors
and omissions may be accepted at the Promoter's discretion. Failure by the
Promoter to enforce any of its rights at any stage does not constitute a waiver
of those rights.
5.Only one (1) entry permitted per person.
6.Promotion commences on the 15/02/2010 at 9am. Entries close on the
14/03/2010 at 11:59pm. All times will be based on Sydney local time. The
draw will take place at Mobux Pty Ltd, 7/50 Reservoir Street, Surry Hills, NSW
2010 on the 15/03/2010 at 10am. Winners will be notified by mail. Winners’
names (of prizes valued at over $250) will be published on
www.memberslounge.com.au and any Victorian winners (of prizes valued at
over $250) will have their name published in The Australian within 14 days of

the draw date. The Promoter’s decision is final and no correspondence will be
entered into.
7.The first valid entry drawn will receive an “Evermore Members Gig Prize”
valued at up to $900 depending on point of departure. The Evermore Gig
Prize is a trip for two (2) adults including return economy airfares from the
winners’ nearest capital city to Sydney, two (2) tickets to see Evermore
perform live at Virgin Mobile Metro on 20/03/2010 including a VIP meet and
greet of the band with free catering and a free drink, one (1) night
accommodation at a 4 star hotel.
8.The Evermore Members Gig – Virgin Mobile Metro ticket prizes are subject
to the event venue and ticket terms and conditions, including any applicable
age restriction. The Promoter and event organizers hereby expressly reserve
the right to eject any winner (and/or any companion) for any inappropriate
behaviour, including but not limited to intoxication, whilst participating in any
element of the prize. The winner (and any companion) will be responsible for
their own transport to and from the event venue and any costs associated.
9.If any prize is unavailable, the Promoter, in its discretion, reserves the right
to substitute the prize with a prize to the equal value and/or specification,
subject to any written directions from a regulatory authority.
10.Total prize is $900 RRP. Prizes, or any unused portion of a prize, are not
transferable or exchangeable and cannot be taken as cash.
11.The Promoter will conduct an unclaimed prize draw (if required) at the
same place as the original draw on the 17/03/2010 at 10am to award the
prize. This date will be no sooner than 3 months after the original draw,
except in the case of an event prize, in which case, the draw may be earlier.
In the case of any winners (of prizes valued at over $250), their names will be
published on www.memberslounge.com.au and any Victorian winners’ names
will be published in The Australian within 14 days of the unclaimed prize draw
date.
12.If this promotion is interfered with in any way or is not capable of being
conducted as reasonably anticipated due to any reason beyond the
reasonable control of the Promoter, the Promoter reserves the right, in its sole
discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or
(b) subject to any written directions from a regulatory authority, to modify,
suspend, terminate or cancel the promotion, as appropriate.
13.Except for any liability that cannot be excluded by law, the Promoter
(including its officers, employees and agents) excludes all liability (including
negligence), for any personal injury; or any loss or damage (including loss of
opportunity); whether direct, indirect, special or consequential, arising in any
way out of the Promotion, including, but not limited to, where arising out of the
following: (a) any technical difficulties or equipment malfunction (whether or
not under the Promoter’s control); (b) any theft, unauthorised access or third
party interference; (c) any entry or prize claim that is late, lost, altered,

damaged or misdirected (whether or not after their receipt by the Promoter)
due to any reason beyond the reasonable control of the Promoter; (d) any
variation in prize value to that stated in these Terms and Conditions; (e) any
tax liability incurred by a winner or entrant; or (f) use of a prize.
14.The Promoter collects personal information in order to conduct the
Promotion and may, for this purpose, disclose such information to third
parties, including but not limited to agents, contractors, service providers,
prize suppliers and, as required, to Australian regulatory authorities. Entry is
conditional on providing this information. The Promoter may, for an indefinite
period, unless otherwise advised, use the information for promotional,
marketing, publicity, research and profiling purposes, including sending
electronic messages or telephoning the entrant. Entrants should direct any
request to access, update or correct information to the Promoter. The
Promoter’s privacy policy can be located at www.virginmobile.com.au. All
entries become the property of the Promoter.
